The potential consequences seem straightforward: Some projects could require more equity, some retrofit packages could become harder to justify and some owners might turn more heavily to alternative financing.

Months later, however, there’s little evidence of that shift.

New York City Energy Efficiency Corp. has seen limited impact in conversations with building owners. Bayview PACE, for example, has not encountered a transaction in which financing changed because of the cutoff. And the Institute for Market Transformation expects only a marginal effect on jurisdictions’ building performance standards planning.

The muted response doesn’t mean 179D lacked economic value. It raises a different question: How central was the deduction to the decisions CRE owners were already making?

One piece of the underwriting

For tax years beginning in 2026, Section 179D’s base deduction ranges from 59 cents to $1.19 per square foot, depending on energy savings, with substantially higher amounts available for projects meeting prevailing wage and apprenticeship requirements.

The construction cutoff excludes work beginning after June 30, rather than eliminating deductions for all previously qualifying projects. The owners most directly exposed, according to Cliff Majersik, senior advisor at IMT, are those that had explicitly incorporated 179D into their capital plans and intended to meet the labor requirements necessary to maximize the deduction. For those owners, losing the benefit changes the calculation. But NYCEEC’s experience suggests the deduction was rarely the only—or even the dominant—variable determining whether a project moved forward.

“We have seen limited impact,” said Curtis Probst, president & CEO of NYCEEC. Building investment decisions, he noted, depend on factors ranging from real estate values and financing availability to hard and soft costs, energy prices, regulatory requirements, tenant considerations and other incentives. All else being equal, Probst said, losing a tax benefit generally increases the owner equity needed for a project. In some cases, the absence of an incentive can affect whether a project is financeable.

But all else is rarely equal.

Higher energy costs, for example, can increase the value of efficiency improvements. Greater avoided utility costs can produce more incremental cash flow and potentially support additional debt, reducing the owner’s equity requirement. Grants and incentives are preferable to taking on more debt, of course, but both can improve project economics.

In other words, the effect of losing 179D therefore depends partly on what else is changing in the capital stack and underwriting.

No clear shift in financing

C-PACE appeared to be one place where a funding gap might become visible. Its long repayment periods could allow owners to finance more of a qualifying improvement instead of contributing additional equity.

Yet Bayview PACE has not encountered a deal in which the loss of 179D changed requested C-PACE proceeds, sponsor equity, deal structure or the decision to proceed. Anne Hill, senior vice president at Bayview PACE, said the company simply hasn’t had such a situation arise.

READ ALSO: NYC Has New C-PACE Rules. What’s Changing for Borrowers?

Unlike a federal tax incentive for commercial real estate, C-PACE is privately funded financing and does not disappear when a tax provision expires. Its availability, however, doesn’t recreate the value of the deduction. Additional financing can ease an upfront capital constraint, but it adds a repayment obligation. For an owner that had counted on 179D, the question is whether a project’s remaining benefits justify that cost.

Compliance keeps projects on the table

In markets with building performance standards, owners may have less flexibility over whether to invest at all. The disappearance of an incentive doesn’t remove mandatory emissions or energy-performance requirements.

“In some cases, building performance standards are changing the discussion from ‘whether’ to ‘how’ or ‘when’ to do energy-efficiency work,” Probst said.

For those properties, the effect could emerge through greater equity requirements, phased improvements or altered timing rather than an abandoned project. Jurisdictions implementing the standards are making their own adjustments.

“Jurisdictions have always looked to 179D as one of many incentives and financing options to recommend to building owners,” said Majersik. Leading jurisdictions are already factoring its absence into their BPS planning, he added, but “the absence of 179D should have a marginal impact on those plans.”

The loss may therefore complicate an individual owner’s compliance strategy without substantially changing a jurisdiction’s policy direction.

Majersik also noted that markets should ultimately incorporate any financial effect from 179D into pricing and transactions. Isolating that effect may prove difficult, however, with interest rates, access to capital, vacancies and weakened office valuations also shaping investment decisions.

The pipeline has yet to turn over

Timing further muddles the picture. Projects that began construction on or before June 30 may remain eligible, subject to the deduction’s other requirements. Work conceived and underwritten entirely without 179D may not yet be far enough along for changes in financing, scope or execution to become apparent.

The early response therefore leaves two possibilities open: The deduction may have played a smaller role in many owners’ underwriting than its prominence in federal energy policy suggested, or its loss may become more visible as the project pipeline turns over. Both could be true.

For now, most specialists describe limited disruption. The more revealing test will be how owners adjust plans that previously included the deduction: whether they contribute more equity, narrow the scope, delay the work or proceed on the strength of energy savings and compliance needs.

So, the question that began as how will commercial real estate replace 179D? may therefore have a more revealing follow-up: Where will its absence actually change a decision?

Lenders report limited disruption for now, but the next wave of projects could reveal changes in equity needs, scope and timing.

"_jetpack_memberships_contains_paid_content":false

21825,23891,52682,21786,51037
52312,42068,33075,34817
post-1004812548","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-finance","category-national","category-policy","category-sustainability","category-trends","tag-bayview-pace","tag-institute-for-market-transformation","tag-new-york-city-energy-efficiency-corporation","tag-tax-policy

CRE Lost the 179D Energy Tax Break.
