Katie Hobbs announced that she wants to remove tax incentives for data center operators in the state, which have been in place for more than a decade.<\/p>\n\n\n\n<p>Simultaneously, New Jersey assemblymembers were advancing legislation that would have raised electricity costs for certain data center operators, which former Gov. Phil Murphy pocket vetoed as one of his final actions in office on Jan. 20.<\/p>\n\n\n\n<p>The moves represent the divergent paths states are taking toward data center regulation, as politicians seek to balance constituent pushback toward the sector with potential economic benefits.<\/p>\n\n\n\n<p>\u201cMore than a decade ago, we made a strategic decision to grow data centers by creating a tax exemption for them. I voted for it,\u201d Hobbs said in her annual <a href=\"https:\/\/azgovernor.gov\/office-arizona-governor\/news\/2026\/01\/governor-katie-hobbs-lays-out-plan-lower-costs-and-put-arizona\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">State of the State address<\/a>. \u201cNow, Arizona is a national leader in this sector. We must ask ourselves: Should taxpayers continue subsidizing the data center industry?\u201d<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity has-very-light-gray-to-cyan-bluish-gray-gradient-background has-background is-style-wide\"\/>\n\n\n\n<p><strong>READ ALSO: <\/strong><a href=\"https:\/\/www.commercialsearch.com\/news\/commercial-real-estate-trends\/\">Commercial Real Estate Industry Outlook<\/a><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity has-very-light-gray-to-cyan-bluish-gray-gradient-background has-background is-style-wide\"\/>\n\n\n\n<p>The tax incentive, which the governor said costs the state $38 million annually, is partly why Arizona is one of the top data center markets in the country, in addition to the state\u2019s climate and power availability.<\/p>\n\n\n\n<p>To qualify for sales and use tax exemptions, operators must spend at least $50 million on the construction or expansion of a data center in Maricopa or Pima counties, or $25 million in any other county, according to <a href=\"https:\/\/www.axios.com\/local\/phoenix\/2026\/01\/14\/arizona-data-center-tax-break-repeal\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"><em>Axios<\/em><\/a>. Removing a tax incentive requires a two-thirds supermajority in the statehouse.<\/p>\n\n\n\n<p>David Guarino, head of global data center and tower research at Green Street, told <em>Commercial Property Executive <\/em>that while the removal of the tax exemptions would make the Arizona data center market slightly less appealing, the region\u2019s other strengths would likely still entice developers.<\/p>\n\n\n\n<p>\u201cPhoenix is still a very pro-business market, not to mention it has some of the cheapest power rates in the country relative to other markets,\u201d Guarino said. \u201cI don\u2019t think it would materially change the outlook for the market.\u201d<\/p>\n\n\n\n<p>Guarino added that the purpose of tax exemptions like Arizona\u2019s is often to attract a particular industry to a market and help that industry become sustainable on its own. Murphy did not explain his reasoning for the pocket veto.<\/p>\n\n\n\n<p>In prepared remarks following Murphy\u2019s decision, Ray&nbsp;Cantor, deputy chief government affairs officer at the New Jersey Business &amp; Industry Association, called the bill a \u201cmisguided attempt\u201d at protecting average consumers from rate increases and said a better way is to <a href=\"https:\/\/www.commercialsearch.com\/news\/sior-special-report-how-to-dominate-the-data-center-market\/\">encourage more power generation<\/a>.<\/p>\n\n\n\n<p>Guarino said the New Jersey legislation was in line with broader national trends, where more and more utility providers are placing a heavier financial burden on large load requests.
