With the presidential elections drawing closer and the race between President Donald Trump and former Vice President Joe Biden getting tighter, economist Ken Rosen has some advice for commercial real estate owners: \u201cIf I owned a lot of real estate and wanted to do a 1031, I would do it now.\u201d<\/p>\n

Rosen, chairman of Rosen Consulting Group and Fisher Center for Real Estate and Urban Economics at the Haas School of Business at the University of California, Berkeley, said Biden has proposed eliminating the 1031 exchange<\/a> to pay for his $775 billion child care and elder care plan. Used to defer capital gains, Trump\u2019s 2017 Tax Cuts and Jobs Act saved the tax exchange utilized for decades by real estate investors.<\/p>\n

Biden has also proposed raising the capital gains tax rate for individuals with incomes higher than $1 million and raising the top individual tax rate from 37 percent to 39.6 percent. He has proposed taxing carried interest, used in many real estate partnerships and treated as a long-term capital gain, as ordinary income.<\/p>\n

\u201cRaising the capital gains (tax rate) and eliminating the 1031 would create a 20 percent decline in commercial real estate values. Real estate would be subject to the capital gains tax at a very high rate,\u201d Rosen said.<\/p>\n

To date, 1031 exchanges have provided liquidity in the CRE market, particularly during times of market stress like the Great Recession in 2008 and 2009, explained Mike Flood, senior vice president, commercial\/multifamily policy and member engagement at the Mortgage Bankers Association.<\/p>\n

\u201cWhen I think of times when the market was illiquid, like in \u201908 and \u201909, it was the only thing that could keep markets moving,\u201d said Jeffrey DeBoer, president & CEO of the Real Estate Roundtable.<\/p>\n

Biden\u2019s proposed change on capital gains could depress deal activity, especially if linked with loss of the 1031 exchange, because investors would retain assets longer, noted Matthew Berger, vice president of tax at the National Multifamily Housing Council.<\/p>\n

While Trump has not released tax policy proposals as part of his reelection campaign, he has pointed to the TCJA as a signature piece of legislation. He has talked in general terms on the campaign trail about initiating more relief for lower-income and middle-income taxpayers but not provided details.<\/p>\n

Opportunity zones debated<\/h2>\n

The TCJA also introduced Opportunity Zones<\/a>, which encourage private development in low-income areas, with the deferment of capital gains and reduction of tax liabilities. While critics say there has only been about $10 billion invested and the projects have not improved economic conditions for residents, the Trump administration claims that $75 billion was raised by Qualified Opportunity Funds<\/a> by the end of 2019.<\/p>\n

In August, Trump issued an executive order directing more federal agencies move their offices into Opportunity Zones, and later said the program would be expanded but did not offer specifics.<\/p>\n

Biden and fellow Democrats have increasingly called for changes to make the program more transparent, calling for more disclosures on projects getting tax breaks and for developers to be held accountable for direct benefits to communities.<\/p>\n

CCIM Institute President Eddie Blanton, principal & senior adviser with Tradd Commercial in Charlotte, N.C., said while there had been \u201can influx in investment capital\u201d in Opportunity Zones, the approval process can be a lengthy one depending on the location. But he called it a very important program for capital formation and said CCIM would support enhancements.<\/p>\n

DeBoer said he expects a review and changes no matter which administration is in charge next year but doubts Congress would repeal it.<\/p>\n

\u201cThe issue will boil down to be is there an opportunity within the Opportunity Zone for minorities and women-owned businesses for them to participate in this. That\u2019s certainly a legitimate debate to have,\u201d DeBoer said.<\/p>\n

Multifamily funding plans<\/h2>\n

Biden issued a wide-ranging plan to invest up to $640 billion in federal funds to improve public housing and provide rental assistance to a larger number of Americans, including issuing Section 8 housing vouchers to every eligible family and increasing funding to make that happen.<\/p>\n

While Trump has not released campaign proposals, the fiscal 2021 budget proposed for the Department of Housing & Urban Development doesn\u2019t provide funding for capital projects in public housing properties, seeks a 10 percent cut to public housing operating budgets, and cuts Section 8 vouchers by $5 billion.<\/p>\n

Cindy Chetti, senior vice president of government affairs at NMHC, said the association has tried to work with the Trump administration but there is \u201cnot much appetite right now to do legislative work on Section 8 reform.\u201d<\/p>\n

\u201cWe certainly have been very focused on it and want to do what we can to streamline the program and get more participation,\u201d Chetti said.<\/p>\n

Biden is also proposing a $20 billion increase for the national Housing Trust Fund to incentivize states, municipalities and developers to build more affordable housing. The Trump administration\u2019s proposed 2021 HUD budget would eliminate the HTF. It would also cut Community Development Block Grants, which Biden wants to boost by $10 billion, and the HOME Investment Partnership program.<\/p>\n

GSEs, housing finance reform<\/h2>\n

The Trump administration last year pushed for the GSEs\u2019 conservatorship to come to an end and for Fannie Mae and Freddie Mac to be privatized. That has also been Federal Housing Finance Agency Director Mark Calabria\u2019s goal.<\/p>\n

But Mike Flood, senior vice president, commercial\/multifamily policy and member engagement at the Mortgage Bankers Association, questioned whether would stay under a Biden administration. \u201cWould that change under Biden?\u201d Flood asked. \u201cThey might have a different philosophy.\u201d<\/p>\n

Chetti also raised the issue of housing finance reform and a possible change in Senate leadership. \u201cIf the GOP retains the Senate, there are some members that are very much focused on housing financing reform and would like to see that job get done,\u201d Chetti said.<\/p>\n

Rental assistance and eviction moratoriums<\/h2>\n

On Aug. 1, Biden called for Congress to prevent evictions and help struggling landlords by enacting \u201ca broad emergency housing support program.\u201d A month later, Trump signed an executive order enabling the Centers for Disease Control and Prevention to use its authority to halt evictions through the end of 2020 to slow spread of COVID-19. Multifamily and commercial real estate industry officials are pushing for assistance for renters impacted by the pandemic because they are worried about accrued rent.<\/p>\n

\u201cAn eviction moratorium is not a long-term solution. It kicks the can down the road. We\u2019re very supportive of rental assistance for folks that are experiencing hard times and hardships,\u201d said Chetti.<\/p>\n

Blanton said relief should also be available to commercial real estate renters, owners and CMBS borrowers. \u201cBottom line: It\u2019s critical for the entire CRE industry.\u201d<\/p>\n
